TCPA consent

The consent you give

When you submit a lead form on the AdvertisingML network, the consent language you click to accept is functionally similar to the following:

Exact wording is versioned at the property and form level. The version of the consent language in effect at the time of your submission is captured as part of the consent metadata along with timestamp, IP address, and the TrustedForm certificate issued by ActiveProspect.

Multi-seller consent framework

We rely on the multi-seller consent framework affirmed in Insurance Marketing Coalition v. FCC (11th Cir., Jan 2025). Consent language names AdvertisingML and links to the maintained partners list at /partners, identifying the categories of advertisers who may contact you. Specific named delivery partners in the relevant vertical are disclosed to you at the form submission step.

Revocation

You may revoke consent at any time through any reasonable means:

  • Reply STOP, END, QUIT, CANCEL, UNSUBSCRIBE, or OPT OUT to any text message you receive;
  • Click the unsubscribe link in any email you receive;
  • Ask any caller to remove you from their list;
  • Email privacy@advertisingml.com with "REMOVE" in the subject line.

Revocations are honored network-wide and propagated to all named delivery partners within ten business days, in accordance with the FCC consent revocation rule (effective April 11, 2025). Per FCC guidance, one confirmation text containing no marketing content is permitted within five minutes of an opt-out.

Internal Do-Not-Call list

Numbers that opt out are added to our internal Do-Not-Call list. We do not contact numbers on our internal Do-Not-Call list except for the single confirmation text described above. We honor the National Do Not Call Registry and the equivalent state-specific Do-Not-Call lists.

State-law layered consent

For Florida-, Oklahoma-, and Washington-resident consumers, our consent disclosures meet the enhanced standards applicable under the respective state mini-TCPA frameworks. For California-resident consumers, our consent disclosures meet CCPA / CPRA requirements regarding the sale or sharing of personal information for cross-context behavioral advertising; see also our Do Not Sell or Share My Personal Information page.

Recordkeeping

Consent records are retained for at least four years from the date of submission to meet recordkeeping obligations under TCPA. Records include the consent language version, timestamp, IP address, user agent, page URL, and the TrustedForm certificate URL.
